My brother got arrested a month ago for possesion of Marijuana. He had less than an ounce on him and it was his first time in trouble with the police. He is going to court tomorrow - What should we expect to happen, what could be his punishment? how long does it take? Anything else I should know?

This is in NYC

Expect that unless he goes to treatment and gets into recovery, he'll be having alot more court dates, for a lot worse crimes, doing alot worse drugs, and it won't stop until he hits bottom. How do I know? Been there, done that. Don't want to do it again. Clean 2 1/2 years. See if he's hit bottom yet and wants help, not just to "get off".

It depends on what he was charged with, exactly,(like, Penal law section xxxxx,) how old he is, are you sure he has NEVER been in trouble with the police, did they put him in jail when they arrested him? Also, the critical thing to ask for when brought to court on a drug charge is the LAB REPORTS. if the do not have these the case cannot go forward,(at least that day). In my jurisdiction in New York, if they don't have the reports on marijuana upon your initial appearance in court, they are obliged to give you a violation only, and drop all other charges. (a violation is like a parking ticket). If you don't have a lawyer, ask to have one appointed when you get to court. They will give you a paper with a phone number and a return date for court.

If it is just small possesion most likely rehab of some sort, a large fine, parole for a year or more, and community service.

My cousin spent 5 years in prison for drug trafficking. Not sure how long his parole is.
