I have been trying to contact my attorney for a while to get an update on any developments in my civil lawsuit. I have had a case with him for about 6 years now. During this time, he never calls me with updates and everytime I try to contact him, he never returns my calls. I went to the CA state bar website and found out he has been suspended for 2 years. Is it possible to get my money back and how would I fire him?

The California State Bar, not any county bar association which would only be a voluntary professional organization in California, is the state agency charged with lawyer discipline. The California Bar has a client security fund that may apply. Contact them at (800) 843-9053. They almost certainly will tack onto the lawyer's suspension for failing to obey the terms of the suspension.

Make two calls, first the Bar Assn in the county that you are dealing with this atty...see if they have a fund to protect you in court of standby lawyers and if they refund any fees that he may have collected from you. They usually have a fund to protect the image of the legal profession. Then call the District Atty and tell him what happened with the atty in question, what the Bar Assn said and see if you can press charges against our atty. It depends if he actually did anything in court or filing any paperwork with the court that is criminal and its misrepresentation. Money collected for that is theft, grand theft depending on the amount. Good luck

You will need to hire another attorney.

File a complaint with the bar about your former attorney even if he is suspended.

Your new attorney will know (or should) what to do, he'll have to file a motion for change of counsel which should be a routine motion.

You would need to contact the State Bar and find out if they can obtain your files and you can have them transferred to another attorney.

Is he suspended from the state bar by a piece of rope, perhaps, former disgruntled client? LOL I suggest finding a new lawyer with good references and you can probably kiss your money goodbye...
