my girlfriend was married in California 6 years ago [ her and her husband were here illegal ] she a 100% child custody established and divorce completed in Mexico how ever Mexico will not let us get married because they have nothing from California saying that they were divorced [ there as been no contact between lawyer there and the united states ] now I have learned that we have a treaty with Mexico stating that we except laws rulings and decision from Mexico and have been told that only it need to be recorded here at the clerks office in ca. well two years and two lawyers latter it is turning in to hell! no I thinking of scrapping the whole idea and just getting a new divorce done her and so her is another problem how do two Mexican citizens get a divorce here there is no way for either to get here legally to sign or file papers?
is there a state where it is not needed to be present in person or how to get a Mexican divorce recognized here? this as to be very simple but .....

Marriage, divorce and citizenship are three separate legal issues. Her marriage or divorce records should be available in the county seat (court house) of the county where she was married - or divorced. I don't know how it works in Mexico, but those records should be available where the legal procedure occurred. However, I have heard that it is very hard to get things like that done in Mexico. In CA it takes a letter and a check - usually not a problem.
Divorces in Nevada are pretty easy to get but you have to prove you have lived there for a certain number of weeks. Most people who do this live with friends for a while - or just say they have. I don't know if you have to be a US citizen to get a divorce in Nevada. I don't see why it would make any difference. Getting a second divorce - don't even mention the first one from Mexico, might be the best way to go.
Not having US citizenship is a sore point with many US citizens. You can't blame us. Consider starting that process. It may take a while but it will make your case look better in the eyes of the government if you have at least applied.

Generally unless the illegal commits a felony then there isn't much chance of them getting deported. The US does not want to spend money to deport them to have them come right back illegally again. However if a legal citizen marries an illegal they are not just automatically considered to be legal. They have to apply for citizenship through Immigration just as if they were coming here legally. And there is the possibility that even though they have married INS may require they go back to their country for a certain amount of time to be granted a visa legally and/or get a legal green card to be here.

This is a perfect example of why everyone should stay in the Country where they are born. USA has enough problems, we don't need anymore people from Mexico or anywhere else here.

if he was illegal, was the marriage legal, check with an attorney
