I need to know everything that a judge does in a courtroom. I know that he/she makes the decision on who is going to win the case. Now I need to know what else they do, and I need to know alot. Ig you want to help me more you can give me discriptions on lawyers, attorneys, and a court reporters. Thanks to everybody that helps me out!!!!!!!!!

In common law countries, such as the United States, and those with roots in the British commonwealth, judges have a number of powers which do not exist, or are not acknowledged to exist, in civil law legal systems, which collectively make the judiciary a more powerful political force than in civil law countries.

As others have said, "freedom of speech" does not mean that courts cannot demand a reasonable level of order in a courtroom, especially when the nature of a court proceeding is such a delicate matter that has to be handled with utmost care. The freedom of speech found in the First Amendment to the U.S. Constitution has certainly been expanded to protect lots of types of speech, but there are important exceptions that the U.S. Supreme Court has carved out. Take a look at Chaplinsky v. New Hampshire and, more importantly, Cohen v. California for excellent discussions of why the freedom of speech is not absolute. Courts have to maintain order, and there are very specific rules about what can and cannot be considered in a judicial proceeding. No one is above the law, and if a judge tells you to do something, you MUST do it, even if you know it's illegal for him or her to do so. You can challenge it later, but judges rule their courtroom, as they should. American judges understand far, far better than you do about the law.

The judge rules on questions of law.

In any legal matter, there are questions of fact (what happened) and questions of law (interpretations of rules). Questions of law include what laws might be applicable, how the standards and tests are applied to the facts, what evidence is admissible, etc.

In a jury trial, the jury determines questions of fact. In other words, the jury determine what happened. The judge determines the test/template/formula that will be applied. So, take a simple assault/battery case. The elements would be a harmful/offensive touching, to another person, done intentionally, by the defendant.

So, the jury would have four factual questions to address. Did a touching of another person occur; if so, was harmful/offensive; if so, was it done by the defendant; if so, was it intentional. If all four questions of fact come back yes, then the elements of battery are met. So, the judge doesn't usually decide who wins. The judge just determines what the appropriate rules are and the jury determines if those rules/elements have been met.

Now, in some situations, there is no jury and the judge also acts as trier of fact. This is called a bench trial, and happens for minor crimes/violations, or some civil matters. Parties can also waive a jury trial and elect a bench trial.

But the judge's main duty is to determine what happens when, and to make rulings on matters of law.

"A judge chiefly acts act as a mediator/ref. in a courtroom to maintain order and decency. A judge can also add to your sentence ( community service, anger man. classes, fines). Do not get on the judge's bad side!"

a judge is basically the "referee". He helps keep order in the court and ensure the rules are being followed. 4 instance, if a lawyer objects, the judge decideds if what the other lawyer did is fair.

a judge, judges. they wear a robe. they oversee the court cases. depending on the type of court. they also make the rulings. oh, and they also sign warrants for arrest and so the police can legally break into and enter your house. that kinda stuff. watch people's court and judge mathis....you'll see.
