Before meeting my ex I had a house which I sold to live near her. The new house was mortgaged in my sole name before getting married and having one child.
The house was remortaged in January 2005 to help pay off debt she help accumulate, and debts continued to accumulate in excess of £18,000
Due to excessive spending, eventually a personal loan had to be taken out of £15000 agian in my sole name. Financial situation got so bad that there was not sufficient money to pay for sufficient heating, food and clothing. Many arguments erupted when I asked her to try to cut down.
This year she said she seperated from me, saying she wanted her own money (been married 2yr) and met someone else, (she’s since got herself into more debt!). Leaving me to stuggle on my own. She's never worked, and since got herself a new house with rent paid for by social security. She now says she wants my house!! This is so unfair. Is she entitled to it, and make me even worse off, leaving me homeless?

Just to clarify.. no she has no money. she's on legal aid, yet already has a house being paid for by social security. Why are some women such bitches. I've done nothing wrong. She walked out on me, and I'm left to pick up the pieces. She just takes what she wants. Does it matter that the home was bought in my name before getting married??

No cheap advise for this one... sorry. That question is best left to a lawyer.

The real question is this: if she takes the house in the divorce, are you off the hook for the payments? If so, it may not be such a bad thing to live with family for a bit until you can get an apt.

Her wanting the house MAY be the first step in you getting out of debt... but only if she takes on the payments, which it seems like she would.

First, get a lawyer for legal consultation. It will cost you but it's worthwhile. In fact, write a list of questions to ask so that you get your money's worth. Second, figure out if you are in a no fault state and what the rules of community property are. Any property purchased before marriage may not be considered community property and she would have no claim to it. However, the question of the refinancing will have to come into play.

Also, the term separattion is a term of art. Check with your state requirements on when that is. Why? You might have a claim over her new house if you are not legally separated by definition of the court. That might be community property. You may also request the court to order her to liquidate the property in order to pay for the divorce.

BTW, what about the child in all of this? Don't forget him/her.

Some women are such bitches because they are so totally selfish. Some women have a very simple thought process:

Good for me (what she thinks she wants even though it messes up her life big time) = good

Bad for me (not getting what she wants) = bad

Wrong - (?) - see good for me or bad for me..

She sounds dumb. Let her destroy herself like most dumb women end up doing sooner or later. Many women are not wired to use reason, delay gratification etc. Rebuild your life. Don't think about her. Don't worry about the house - if you owe more than it is worth let her have it and the debt! She will be so focused on winning and getting it that she may not even realize she is making a mistake. Use her stupidity and greed against her!

I THINK since she left you for someone else you should keep everything INCLUDING THE KID. talk to an attorney QUICK...i know money IS an issue and it doesn't sould like there is anywhere you can turn for legal help for free based on the circumstances... i'm sorry i don't have better news to report to you... bankruptcy may be an option here... but i don't know the laws in your country... i'm in the U.S.
