Because they put it to a vote, and people chose the Texans. Which was the original name of the Kansas City Chiefs, who owned the rights to the name. Just like Tennessee had to get permission from the New York Jets to use the name Titans.
Tennessee still holds the rights to the Oiler records, unlike the situation in Baltimore, where Cleveland retained the rights to the Browns after the team left. Houston had no claims to the Oiler name.
But, even if they did retain the name, they would still suck.

We got Houston's rejects with "Airhead" McNair and they got a new team. We should have gotten a brand new team instead of them. Don't worry, Houston is better off now. I doubt the Texans will ever be able to be the choke artists that the Titans/Oilers have been throughout the years, ie the 1992 comeback when the Bills beat them and the Super Bowl against the Rams. It's hard work sucking that bad, lmao.

There is precedent for naming a new franchise after an old one that has moved and since changed its name. The Cleveland Browns are named after the original Cleveland franchise which moved to Baltimore and are now called the Ravens. I think Houston went with the name Texans because it's cooler than Oilers.

My understanding is the Titans team owns the right to the Oilers nickname for football. Just like the Rangers baseball team owns the name for the Senators and hence the Nationals came about. Texans is actually an old Historical football team name. If only the team wasn't so gosh awful.

It has to do with brand name. The Texans owner wanted to start his own brand image and use the state of Texas as his big marketing gimmick.
The franchise in Tennessee has rights to Oilers royalties and brand name as well.
Texans would lose a lawsuit now, but would eventually win if they wanted to revert to the name Oilers down the road. It has to do with protecting a brand name (kind of complicated).

I dont think the name has anything to do with their success. The Oilers franchise was moved to Tennessee... the Texans are a new franchise. Hey, things can turn around in a couple of seasons... dont count any team out of the superbowl.

Really I think they wanted a fresh start. The Oilers did not ever really do very well. So they took on the name of the original Houston franchise.
