I doubt if you can open a smoker's bar, however depending on the language of the law, you can open a private club, charge a small fee to be a member, not open to the public. If it is a private club, they can't touch you if it is not written in the ban.

It's perfectly legal, you just have to post a sign on the outside of your building that clearly informs all people that the indoors is for smokers only and that non-smokers will encounter second hand smoke by passing in front of the door or entering your building. You also must have one of those blowers on your door to blow smoke back into the building as the door is opened.

Check with your local zoning commision as to the actual laws a regulations you must follow, your bar may have to pay a "sin tax" for being a smokers only bar.

I wish they could open a smokers only bar..in some cities there are certain requirements to have smoking in bars..like the ceilings have to be so tall..and there has to be good ventalation...

I am with you on the smokers only bar thing...You can't drink a beer with out a ciggy..its just not right!

I know several bar owners that tried to not enforce the law in their California bars... until they could no longer afford the fines. I have a couple of friends who tried to get a smoker's permit, even a specialized one for cigars only, however apparently they do not have one available. Good luck if that's what you choose to do.

If a smoking ordinance is created at the city level, all businesses within that city MUST follow the ordinance (or face penalties). Pretty simple. If there is no smoking ordinance at the state level, move to another city to open a smoking bar.

If the ban is for bars, you won't be able to allow it.
I live in Mass. and in my town theres 3 private clubs.When the town first started the ban, the private clubs were exempt until the Dept. of Public Health and the 3 owners of the clubs went to court.When it got to the states supreme court,the DPH won.

in my state smoking is only banned in bars where the majority of their sales come from food. so if you open a bar that doesn't serve food, people can smoke until their lungs fall out :)

You have to enforce it whether you want to or not -- otherwise you will get fined. (I lived in California and now in Chicago, can't smoke in either.) But there is a way around it in Chicago I can't remember exactly what the loophole is (sorry) but I think it has to do with being a cigar bar.

An easy way to bypass such measures would be to make your bar a private club. Of course check with a qualified attorney for all the details...

This question has been in the news locally (Boise, ID). A restaurant changed it's name to be called a smokers club. Oh, yes, and the club also serves food. Nope, didn't fly here.
