Contact her insurance company and give them all the information she has. Sometimes they will do the litigation against the person. Will make a difference though if she has full coverage or just liability and who her insurance com. is and if she has name etc. of person who hit her.

First she should see if she has Uninsured Motorist protection on her insurance. If she doesn't, she should get a lawyer and sue the person for not having any insurance. She should sue for any car damages and medical expenses. If your friend has Bodily Injury (BI) she can use it to cover her med. expenses as well. Her limit might be $5,000. I wish her the best of luck. Car accidents are not a fun thing to go through!

She needs to call HER insurance company and see if she has 'uninsured motorist protection'. I was rear-ended by an uninsured and non-licensed driver last year and it sucked. I had to pay the deductible which was $250. Depending on the insurance provider, a rental car may also be included in the uninsured motorist coverage. We did not have to sign up for it in Texas - it was automatically included in our policy.

Oh - another thing. I asked my insurance company about suing the guy in small claims court. They said that I could, but if I settled with him and he paid out money to me or a judgement was made, they could not pursue action to recover the cost of damages to my car. I will get the $250 back if he ever makes payments to my insurance company, but I highly doubt I will ever see that money again.

In many states you have to have insurence to buy and drive a car. If there was a police report, maybe you could have it filed through your insurence. Otherwise, Yeah I'd get a lawyer.

Take the person to court and get a judgement for a certain amount. Then, at least, you will have some legal reason to garnish their wages.
