I expect the opposing side to name call on this one, or downplay the sactioning of torture. or that my side is sympathic to terrorist.
They will argue they have no rights as enemy combatants.
This is all garbage, it is dangerous the president can declare anyone an enemy without proof or trial......
We are not Iraq we are suppose to do justice by our nations princples.
We are letting people out of those prisons quietly, why would we do that if they were guilty.
Rumfeld and the Prez ok torture and blamed on 3 or 4 MPS. It all stinks,
The way we detained many was by paying warlords for Tali Ban. War lords were paid by the head, many of these were people with no connection to Al Quedia or enemies of the war lords, farmers.... you think a war lord cares........but who cares right?

All Prison should be like Guantanamo Bay just think of how few prisoner there would be. The prisoners are treated to good we need more chain gangs get them out in the fields on the highways cleaning the streets raising their own food. As far as Guantanamo Bay Again these guys are treated better then any prisoners taken by their Country. A few people got out of line. But for the most part they are being Guarded by the most professional soldiers in the world there are sometimes a few bad apples in a bunch. But other then that.
Go America

The prisoners at Gitmo are all foreigners. Most, if not all, who were fighting against the coalition forces in Afghanistan and Iraq, not as regular army troops, but as irregular troops.
In any war, enemy troop become prisoners of war - POWs - when captured, and are usually held for the duration of the conflict, unless other agreements are reached prior to then. They are in detention, and unless they've committed war crimes, are not going to be tried, because they've done nothing illegal. This is for regular troops, who are wearing identifying uniforms, fighting for an identified entity who also act in accordance with the Geneva Conventions.
Because irregular troops - partisans, insurgents, terrorists, whatever - are illegal combatants per the Geneva Conventions, and because these particular combatants did not act in accordance with the Conventions, they are not protected by the Conventions, except to the extent we decide they are. Legally, we could execute them all, like we did to partisans in WW2.
As for 'torture', they do not torture the prisoners. They do use stress techniques on them to induce them to provide information, but those techniques are a far cry from 'torture'. This is not legalistic semantics but hard definitions.
As an American citizen, you have rights. But if you've engaged in directly supporting the enemy efforts, you can also be detained as a combatant without trial. This is probably because in the trial, the methods they use to find enemy collaborators could undermine national security capabilities. This is very important, and should not be casually dismissed.

Leave aside the right to a fair trial or the right to liberty or security, Guantanamo Bay became the place for the most obvious human rights violations such as the degrading and/or inhuman treatment and/or torture. People whether "terrorists" or not are still being kept there illegally and they're very basic rights are totally ignored by the US. What happened to all the countries claiming to be the "human rights defenders"???
