The lady resides in India.She wants a divorce from her husband who is in jail........is it necessary for the husband to sign on divorce papers?......suppose he doesn't agree to give his signature?

she cant , unless he has be put in the jail for more then 7 years.

I don't see why you couldn't divorce, unless the laws of your state say other wise. Here in Texas you can obtain a divorce any time with them in jail. In fact last year a friend of mine did just that and her lawyer serviced the papers. Also if he doesn't want to go along with it, here you can file for seven years and then a divorce is granted. I woud check with your state laws on this.

It depends on the laws in the state she gets the divorce in. For Example, In New York she can get a divorce after 1 year of seperation on the grounds of "Abandonment".

I take it her husband is in Jail in India too??? You will need to check on what Indian Law requires, it is based on the British system. I think he will have to sign the divorce papers. Best to get a lawyer in India to advise you.

Divorce after one year based on the grounds of abandonment is possible in the USA. The laws of India may be somewhat different. Then, there are religious issues in India which may vary from those in the USA as well.

sounds like someone needs to talk to an attourney. I'd be divorcing his felon asss. But Indians are odd..in the ways of marriage. Their husbands can legally kill them..soo...best to speak to a professional. Consultations are usually free.
