If you had a court order for child support before he went to jail, he should owe back child support for the time he was in jail. Just because someone goes to jail does not excuse them from paying their child support obligation.

THE INMATE NEEDS TO DUE THE PROPER PAPER IN PRISON TO CO TACT THE CHILD SUPPORT OFFICE TO FREEZE HIS SUPPORT TO ADVICE HE IS INCARCERATED AND SHOW PROFF THEN THE CHILD SUPPORT WILL FREEZE ..UNTELL HE IS RELEASED .... IF THE PROPER PAPER WORK WAS NOT DONE WHILE INCARCERATED THEN YES HE MUST PAY BACK ...THAT IS WHAT HAPPENS WHEN YOU FAIL TO PAY........

HE WILL HAVE TO PAY IF HE GET A JOB THEY GARNISH HIS WAGES THE GOV PULL DRIVER LINSENCE TOO SO IT BEEN A ISSUE WITH FATHERS OR MOTHERS IT FACT SOMEONE PAYING FOR THESE CHILDREN SO THE LAW HAS TO STAND UP TAKE THE SLACK IT PAYING THE PRISONERS IT SOMEONE JOB

My brother-in-law doesn't have to. A prisoner is "property" of the state-- so for that time he couldn't pay it-- talk to the overnment for the money.

he can modify the order to null the time he was in.
there is no means for you to make money in custody legally.
Therefore you cannot be penalized for that back support, if you modify the order.
Go to family court and ask for order modification papers.

I'm not sure if he would or not. But my opinion would be yes he should. But law wise or something I'm not sure.
