Yes, it is still legally cheating. You are not divorced. You are not single. BE prepared to see every female you had sex with in court testifying against you and for your wife in DIVORCE COURT. This may go into the calculations of settlements. It can cost you far more than a little fling is worth.

In my opinion... NO...you are still married. I would make really sure that this is what both of you want. If you want the marriage to continue, then ask her if she feels Counseling will work, if she is determine not to give your marriage a good long try, and the marriage is not fixable, then seperation may be the key. Sometimes married couple just need a break from each other.. esp. if there is alot of tension,and argueing. Seperation can me 2 thing's... just a break or legal.. find out which one your wife wants... But i would refrain from haveing intercourse with anyone untill you know for sure that this marriage is so far off the cliff that there is no recovery...

if your wife says she wants to get separated, she's just probably trying to get your attention, now if she said divorce that's another story.
first you need to ask yourself, do i want to save my marriage. becuase i can assure you if you separate and go out with other women and have sex, there's not going to be a chance in hell that you'll be able to work things out.. remember friends - ross & rachel were on a "break"...
if you're not interested in saving your marriage and are completely sure of that fact, you better get a LEGAL separation drawn up by a lawyer so that when you go screwing around, you won't be considered an adulterer. it all depends on you state, like i believe california has a no fault clause, where if you are caught cheating, you aren't legally liable for it.

If the two of you are separating to reevaluate your marriage then I say no to the sex part, however if the two of you are separting and know there's not a chance of reconcillation then I would say to you take your time and get to know someone else, because life is too short to be unhappy!

If you're asking this question, you obviously don't care about working it out with your wife anyway. If you have sex with someone during a seperation, you will only make a bad situation more hurtful. Proceed with divorce. By the way, if she is telling you to go ahead, it is a test to see if you care about her. Obviously, your priorities are elsewhere.

Your wife wants to leave you and all you can think about is being with other women?? I would definately check with a lawyer. In some states, even though you are separated, having sex with other women can still be considered adultry!!

If that question is already on your mind, then you should get divorced. Your first thought is of sex with other women, not how can you fix your marriage. If you have sex with other women now its cheating. The "paper" still exists.

No not at all... Why does your wife want the seperation? It is adultery if you do this until the divorce is final and over with... I think instead of sleeping with others you should focus on your wife and your marriage and trying to save it!
