I am a Police Officer in Oklahoma. I know for certain that although it is not necessary for you to have a drivers license if you are a passenger and it is not required that you have identification BUT it is not against the law for a Police Officer to ask for it. When we stop a vehicle it is common that we check passengers for wants or warrants and to do that we usually ask for id. In the event that someone doesn't have i.d. we can check for wants and warrants using name and Date of Birth.

Yes. Generally, police officers have a lot of discretion to check for ID's when they pull a car over. They usually justify it by saying it is an officer safety issue or there is suspicious activity amongst the car occupants.

Even though they can check the ID of the passenger, they cannot give a passenger a citation for not having an ID like they could the driver. If you were just walking down the street they cannot stop you and ask you for an ID unless they have a 'reasonable suspicion' that you were engaged in criminal activity.

It depends on the state (see Skeeters reply). They can ask you for ID, some states say that you can refuse to answer. Better be sure of the state though, you might find yourself in more trouble than you bargained for. Contrary to what some posters have written, you can refuse to give police personal information unless the officer has reasonable suspicion that you may be involved in criminal activity or driving a car and pulled over for a traffic offense.

A cop can stop anyone and ask him for an id, so why would you believe riding in a car would prohibit him from doing so?

Anytime you are in public, you are subject to being asked to identify yourself. That is up to the police office, most of whom have better things to do than ask people for their id.

What is required is a "reasonable suspicion". If you are in a car with a driver who has commited, or may have commited a crime, most reasonable people are going to conclude there is reason to check you out too. Without a doubt, the best way to get busted for something is to get stroppy with a cop!

It's true. Cops generally only ask drivers for a licence and registration. Never the passenger, except when the passenger is the owner.

Actually, the officer can ask you for your ID. This has happened to my grama before.. She had a fit when they asked her for her license or ID since she was in the passenger side.

cops have the right to ask anyone for an ID, whether that person is on a car or walking down the street.

So the answer to your question is, NON NO NO.
