is the law i can take at the most, 12 weeks w/o pay and they will hold my job even if i have not been there a year? or just 6 weeks?

You are elegible if you have worked for a company for 12 months (1250 hours) and they have 20 or more employees. You can receive 12 weeks leave without pay if you qualify. The site below is a bit detailed, but it might help.

I worked with someone who got pregnant right after she started with us so she wasn't covered under FMLA. What she did was ask our GM if she could work extra hours before she went on maternity leave to reach the 1250 mark. She wasn't able to reach it, but they did allow her the leave and held her job due to her diligence and desire to work with management to return.

I would suggest that honesty with your supervisors is the best way to go about it, if you keep the relationship open you will encourage more trust and respect. Good luck!

Sorry bobbiec..the law is 12 weeks you can take leave of absence for 12 weeks but your job is not required to pay you just to hold your position or "like position" thats under the Family Medical Leave Act you can look it up. If you have short term disability they will pay you for 6 weeks for a regular birth or 8 weeks for a complicated birth ie C-Section. Most short term disability pays only 60-80% of your pay those so save up!
Also Brevejunkie there is no 1 year rule that I'm aware of I was 1 week pregnant when I started my job so I was only there 9 months the FMLA is what it is

If you haven't been at your current job for at least one year by the time you deliver your baby, you do NOT qualify for FMLA (Family Medical Leave Act--where you can take up to three months off and they're required to hold your position for you). If you work for a good company, hopefully they'll give you at least a month off with pay. That happened to me with my first baby. By the time I delivered him, I had only been there 10 months, so I didn't qualify for FMLA. The company, however, honored their regular maternity leave policy of giving employees a month off at 100% pay. I took off two additional weeks without pay.

To qualify for any FMLA (Family & Medical Leave Act) leave you have to be there 12 months. You company may have a policy that gives you the right to lesser amounts of leave. You need to check...
