If child support is the only reason you want them then they should stay with the other parent. Maybe you should try and get joint custody this will lower your child support a lot. Child support is based on your income and the others parents income and how much time you spend with the kids.

I am only assuming you are a man and if that is true then you have a tough battle. You must first take her to court and prove her an unfit mother which is a very difficult thing to do. However, I must say if you want custody just so you don't have to pay child support, SHAME ON YOU. That is a very selfish thing to do. But if it's because you truly love the child and feel they are not being properly cared for then the best of luck to you.

If you are paying child support, you are entitled to visitation rights, which will be set by the court. Do what you can to stick with the court's decision as far as the visitation rights are concerned.
I think the only way you could get sole custody is if you could prove the other parent is unfit, like on drugs for example.

Go to your nearest Family Court House and tell them you want to file a petition for custody. If you want sole custody, you must prove the mother to be unfit.
