If you are paying for it, you get the nice side! A lot of builders are now doing every other panel turned to the flat side when they do new construction. That is how the fences are between our properties. I just put up a trellis on each panel that isn't too attractive to look at from my side.
But, when I replace that fence, you can bet I'll face the nice side toward my house!

The neighbors get the nice side, and the person putting it up gets the not-so-nice side. Make sure you know exactly where the property line is before constructing the fence, and set the fence INSIDE your property line. If you cross over onto the neighbor's property, they can force you to remove the fence at your cost.

The "nice" side is always facing away from the property of the person erecting the structure. Check with your local building department.

Since people gave you both sides check your town if they have any building code about fences. Most towns will give a height limit and if you can choose which side you get. I had a neighbor put up a fence with the unfinished side toward my house and I had them turn it around. So they ended up paying to have it switched so be careful.

If you pay for it you should enjoy the good side. My Sister just went through that with her neighbor. If you both pay for it, you can put up a "good neighbor fence" where each panel, or section, alternates back and forth from good side to bad side. That way you both see the same thing.

YOU CAN PUT YOUR WALL FACING THE NICE SIDE FOR YOU AND TELL THE NEIGHBOR TO FIXED HIS SIDE OWN HIS OWN, EVEN THOUGH THAT HE SHOULD GIVE YOU 50% OF THE MONEY SPENT IN BUILDING THE WALL...
