a person I know recently learned that the sepatation papers she has are not legal do to a technical problem. The spouse has stopped the medical insurance and is planning on doing the same to the car. They canceled it while a child was still in private home school. Can a lawyer help with the anwswer on this? This person would like a staight answer. They were also put out of a rent house and now child has kidney infection and no medical insurance. The child was taken by the spouse then dumped out on the street once their spouse didn't see any usefullness in the child. This was all done to hurt the other spouse and the child. But it makes no sense to anyone I know who knows the person who is being hurt or the child. I have read the supposed "separation papers" and it makes little to no sense to me at all. Just rantings and ravings, it isn't even done by a lawyer. And there is no court date or anything.They are pennieless now, I wish I knew a pro-bono lawyer who would help them out.

These people I know have to live with who ever will let them. And so far they have to move every little bit or live out of a car. Some have allowed them to keep clothes and small things like musical instrument, small radio. stuff like that but they can't store anything for long at any place either.

In this state I have learned that Legal Aid is not interested in marriage cases and will not speak to you unless you have other types of legal actions. And I have a feeling "not interested" would be their answer to the others as well. Unless they are making money hand over fist out of you or a situation, they just don't care.

Unfortunately in this case on the matter of insurance, the person that has the policy can cancel the beneficiaries at any time for any reason. It sounds like it's time to look past the separation papers and go straight for divorce, once that has been started the custodial parent and child can, and should get some assistance.
In the mean time if the child has a serious kidney problem, take it to an hospital emergency room, they will have to give treatment, this will also start the ball rolling for assistance.

It is a sticky depraved hindrance. When she converted banks and the coverage company had no document of her changing banks, the coverage enterprise, in our laptop age atmosphere, said the insured didn't pay the premium and consequently cancelled the insurance. Granted, whoever she talked to should have enter the new knowledge, but due to the fact that that person didn't and there is no record of the coverage manufacturer being notified your daughter is caught in the middle. Out of curiosity, on the date or a day after the automated debit used to be due and hadn't been processed, why didn't she contact the coverage manufacturer? I might go to the agent where she purchased the coverage, provide an explanation for the concern and let him see what he can do. An agent wants to keep his customers and may regularly reduce through one of the most crimson tape and BS in a company.

Actually the person paying can, indeed, cancel these things. It is usually a court ordered continuation of these things that are included in the divorce decree. Insurance companies have only certain times in which one can modify one's health insurance:
open enrollment (usully one timeframe per year)
marriage,
birth,
death,
divorce or
separation (in Michigan, for example, separation is physical requirement and not necessarily legal)

First what she/he wants to do is go to child law enforcement and file for child support, Then they can go through the court and get child support and the judge will make it that the other parent will have to provide insurance and anything else the child needs. Something else is they can go and file for medicaid at dhr, They can tell them the situation and they will be able to to get help within 3 to 5 days, Have the person file for medicaid,food stamps,tanf, Anything to will help them out. The separation papers is not legal at all only because it wasn't filed by the court or a lawyer.

TOOO LONG...
This is sad..BUT
A person can do what they chose..He may not be able to afford it..AND if he can't..There's no law. Regardless of how much of piece of **** he is..

There's the possibility of abandonment..Perhaps she may be able to get child support. You/she needs to see a lawyer for any legal advice.

The reality of the situation she needs to get a job! If they are separated, she really can't expect him to pay everything. She needs to get her independence..Why give a man this much control..Especially if he's able to dictate whether or not she rides, or have insurance. Try temporary medical assistance from the state. She just needs to prepare herself, to support herself and child.. The guy is probably pissed off and doing whatever he can to make her suffer. She just needs to do what she need to do to take care of herself and the children.

Not sure if it is different from state to state. But in general car insurance can be cancelled, however health insurance cannot without a divorce decree.

find a lawyer on a free consultation, and have them look it over and advise. i would ******* sue, thats horrible but ive heard worse. revenge would be best in my case, but try a lawyer or hit the courts with it and make a big stink about it. worse comes to worse hit the press. IM GONNA ASSUME IT WAS A MAN BECAUSE MEN DO THIS. TRUST ME. IT'S AN ISSUE OF CONTROL.

North Carolina sucks a big dick when it comes to divorce laws. I know this from my present experience. Move to another state just long enough to be a citizen there and then file for divorce in that state.
