Your main concern is your children, yes? Would you send your kids off with him if he had been drinking? Well not wearing a seat belt puts children in danger also. It is against the law to have children under 12 in the front seat, and for anyone not to wear seatbelts. If he refuses to listen to you DO NOT send your precious cargo off with him. No judge would side with him on this issue, but document all of your efforts.

I honestly wouldn't allow him to take the kids without them. In doing so, you are endangering the welfare of the children, and I don't think he would be able to get you in trouble for not allowing it. Like, he can't call the cops on you and tell them you won't allow him to take his kids because he has no car seats. If they are with him and he doesn't make them use seat belts, I would call and report him. Someone suggested that to me once should the situation ever come up.

hell yes girl! try 911 or talk to your lawyer. The police will back you up, the new laws were passed (Canada) and all children under 8yrs, 90lbs and 4'9" MUST be in a booster or 5pt harness. He is legally responsible for any passengers under the age of 16 and must ensure they are seatbelted. You may also refuse to let him take them if he does not comply, but make sure you have a witness and document document document! Try showing him your drivers handbook there is info in there too.

It is illegal to have children under 4 yrs or 40 pounds not in a child seat or booster. And obviously illegal to not wear seatbelts. Call the police and ask them what your best bet is. Other option is to call health and welfare dept. and ask them what your rights are as a parent in this situation.

You can call your local Police Department and tell them, I don't know if they'll do anything or not but it can't hurt to try. It's better to be safe than sorry.
