possibly...if you are honest and tell the judge that you have a drinking problem....probably have you go to AA classes...they may, in fact, be the best thing for you....good luck

Too bad stupidity isn't a crime. You really expect a judge to believe you only had two beers, thought nothing of your friend bringing a BB gun to work, of your shooting a gun near a building, of shooting at beer cans, of someone having beer in his vehicle (cold ones, I assume), cocking a gun before putting it into a vehicle and "accidentally" pulling the trigger. Now the gun was in the truck, but shattered the 'dozer window.
Frankly, I would order you held on malicious mischief and a felony destruction of property with intent.

I don't believe you are telling the complete truth. For one thing, the windows on heavy equipment are too thick for a BB to penetrate, and a BB gun is definitely not powerful enough to go through the first window and "shatter" the second one. Security guards are not allowed 'guns' on the job unless they have had academic police instruction and anyone (the guy who relieved you) who is a security guard should be held accountable for carrying or allowing someone to carry a firearm on that property.That security guard should be either fired or reprimanded for bringing the BB gun on the premises and allowing you to drink on the premises. You have to accept the consequences of your actions.

I don't think rehab will be the issue, it will be fines and whether or not this goes on your record. You may be ordered fines and public restitution to get it resolved (if you havent been in trouble before, or it truly was an accident). Also, you probably should be reprimanded for the behavior on the job site. If someone did that where I worked on the clock or not, they would be held accountable for the damage, drinking on premise and be fired or on some kind of probation etc. What about your co-worker? He should be in just as much trouble... odd situation.

I think the judge, being quite experienced and a veteran of hearing stories and excuses, will view your request as a means of skirting personal responsibility. You prefer to blame misconduct on the alcohol, rather than accept the fact that the whole event began with your own flawed judgment. I think you should be apologetic, own up to your misdeed, express (authentic) remorse, take your punishment, and learn from this life experience.

Three simple words "I screwed up". As long as you are not a constant visitor in the courts, admitting that you screwed up and are willing to take responsibility for your actions will help, but if you are a frequent flier in the courts, you should be able to look forward to a stint in the greybar hotel. A couple of beers is not responsible for you doing something stupid, being stupid is the reason you did something stupid. Finally you are responsible for your actions even if you're a lightweight and got drunk off a couple of beers.

Having a judge put you in a rehab isnt goin to solve your problem. You'll still have to pay fines and for the damage. Unless you have a serious problem then you should look into rehab on your own. It takes more courage to go to rehab then having a judge make you go.

My view is that you don't sound like you need to go to rehab, you're just using it as an excuse. Hopefully the judge will see through this farce and give you a punishment you deserve. Now, I'm not saying you should go to jail or anything, but you f*cked up and need to pay for it. Step up, be a man, and just admit your crime.

How do you accidentaly pull a trigger, go to hunters saftey class. Yes a BB will penatrate heavy equipment glass, there are some strong BB guns out there. You got a misdeamenor, no big deal. Drive on and do your time........

You ask, "if the judge will agree to send me to rehab"? Why do you want the judge to agree to this.?
Just, "don't do the same thing again, state you are sorry, pay the fine and costs of repairs and find another job. ."
Problem solved!!!
No rehab required unless that is what you want and even then, I doubt the Judge will forfiet any of the above.

It all depends on the judge, and how persuasive your attorney is. It was an accident after all. Hope all goes well for you, and that you come away with a little more respect for alcohol and BB guns.
