As others have said, if your life is threatened, or someone else is is threatened you can kill them and it will be justified homicide. For example, if they have a gun you could easily get off with justifiable homicide. But what if they don't? Well you could still get off depending on your situation. If you are Hulk Hogan and some guy is robbing you with no weapons it would be hard to say you feared he could kill you. However, if you are elderly, handicapped, short/small/weak or female (though this may not always hold true as some females are pretty tough!) then you could probably say you feared for your life because of your statute. It is also important to note that even if there is no way to justify it, you would not be guilty of murder. At most it would be voluntary manslaughter because the robbery is a mitigating circumstance. Much more is required for both degrees of murder (IE, premeditation, depraved heart, etc.)

That depends entirely on where you live and the circumstances involved.

In all states, you have the right to self-defense, but some states restrict the use of deadly force against anyone, including intruders.

You should consult with a local attorney for specific advise.

If you have been charged with a crime, or you think you will be charged with a crime, say NOTHING other than providing your name, address, etc.

DO NOT SAY ANYTHING ABOUT WHAT HAPPENED UNTIL YOU TALK TO AN ATTORNEY.

Most people talk themselves into prison by trying to talk their way out of prison.

You can only kill a person with deadly force if they are threatening you life. If you shoot someone when they have left your house with your property then you will go to jail. If they threaten your life while in your house then you are justified in killing someone. You will be questioned by the police still.

I would suggest that you take a firearms course in Deadly Force so you know the laws. Each state has their own rules regarding when you can shoot someone.

It is a clear case of self-defense and you didn't mean to kill them, you were just protecting your property. So, no, ideally you wouldn't go to jail. Hopefully the case wouldn't even get a trial but if a family member of the deceased filed charges, then you might have to go to court and in that case it shouldn't be too hard to prove that you acted in self-defense and they were trespassing therefore you did nothing wrong.

In Texas you get a Medal

In Massachusetts you go to jail for life and the robbers family can sue you for all you have for wrongful death, and if one of them got away he can sue you for emotional distress.

God Bless Texas

Not much. Better make sure they were robbing your house and they were in it!

The Bible may read "Thou shalt not kill", though it seems to happen quite frequently in Iraq, Texas and Florida! But that is not the correct translation!

He said, "Thou shalt not murder"!!

in the uk a law has been passed that allows you to remove or 'get rid of' those not welcome on your property by using resonable force, so if the robber went for you with a weapon and you killed him you could plea not only self defense but as the farmer not so long ago did you could claim resonable force was used

you can only kill a person if you say it was self defense.. otherwise it is murder...

but if at trial or whatever.... a person could say they feared for their life.. so i dont think u would go to jail.. unless you killed them and took the time to cut up their bodies

your life has to be in immediate danger like they have a weapon and are threataning to use it and are also close enough to use it.So if the cops show up and he's shot in the back then you would be looking at a risky trial. Arizona.
