Even one has no intetion to commit crime, one's action may harm others. Ignorant actions should be punished in some ways to prevent/remind people from not doing so. You can't accidentally kill someone and say "oops i'm sorry" right? The law is to remind people try NOT to harm others (and help them too).

If there was no intent to commit a crime, yet a crime was still committed then yes there would still be an arrest - but with a lesser penalty - than if there was an intent. A crime is still a crime if you do the wrong thing expect to be punished.

wrong, not intending to commit a crime does not equal no crime.
The judge will lenient if he believe you if it goes to court
