He has physical custody. She see him every other sun for 5 hours she is now in a adult foster home. Does she still have rights. She has not done anything the court order says in it. Also she getting social sercurtity for there son when she don't have him my brother has him.

call the social security board and tell them, and she should not have any rights, but ask a lawyer in ur state

Unless the state or court took ALL rights from her then she still has some rights. Like helping with medical decisons, being imformed when they need surgery. You need to get a hold of someone. I take it she is in this home bc she cant take care of her self then that proves she cant make desicions for the child either. Call the lawyer and get it taken care of soon. You do need to call social sercurtity on her to get that took care of.

A court order is only enforced if you stay on top of it. He has to get in contact with the clerk of the court that issued his court order and tell them that she is in contempt of that court order. Your brother has to stay on top of it because the courts won't know what's going on if you don't tell them.... She is committing a felony... Good Luck........

Apparently, what you are saying is she is in contempt of court which is very serious. She can also be in serious trouble getting social security when child is physically not with her. She is in deep s - - -.

Take action and go see attorney.

Sounds like she is in contempt of the original court order, and the SS Admin. should be notified. It's up to the Judge who set the order to fing her in contempt.
