running around and raving like a lunatic

2006-06-13 14:03:17 · update #1

yeah, but what's so bad about being naked in public? I mean, the only thing that's bad is the cold or insects, but they're not much of a concern.

But I won't walk around naked, I want a social life.

As long as you keep your naked butt indoors or in a colony for nudists, then yes by all means, run around in your birthday suit....just don't point that thing at me.

Sorry but you can not! The right that you are talking about is Freedom of Expression, which is found in the 1st Amendment (Freedom of Speech is what it is commonly know as). Freedom of Expression does not include obscenity. In you case public nudity is considered obscene. If you look at Miller v California an obscenity is spelled out by the following guidelines:
•the average person, applying contemporary community standards (not national standards, as some prior tests required), must find that the work, taken as a whole, appeals to the prurient interest( lustful interests);
•the work depicts or describes, in a patently offensive way, sexual conduct specifically defined by applicable state law; and
•the work, taken as a whole, lacks serious literary, artistic, political, or scientific value.

You and Tarzan, right? In most civilized countries, running around naked and ranting like a lunatic is frowned upon. Better just run naked inside the privacy of your house.

Society is built on compromises. This is one of them.
Your rights become compromised when you infinge on others. For example, you cannot kill someone because it interferes with their right to live. A kind of societal rule like those concerning modesty are not inforced by the national government, but rather local governments that can enforce such rules. National government guarentees the freedom of speech, but local officals can still arrest you if you spout profanity on a street corner.

"Life, Liberty and Happiness", yes running around naked is included, but the laws limit that right (like running around and killing people) for the good of society.
Although you may look cute naked, Sunday school teacher Sally may not like it.

No, because not seeing you running naked is included in my rights. Let's make a deal. You don't run around naked, and in exchange I don't run around naked either, okay? :-)
