When my 1st wife and I divorced I gave up all legal claims and rights to this child whom was 1 year old. It was stated in the divorce that there would be no child support. 9 years later the state stepped in and got a court order for me to pay child support because the mother who had remarried 3 months after the divorce was living on welfare. I have not seen the child nor have I had any contact with her. There was never a paternity test tho it had been requested many times by me.

I agree with what the others are saying, but I want to add one more thing.

When you get an attorney, make sure you have it stated that if the child is NOT yours, you would like to be re-imbursed for your attorney fees as well as the cost of the paternity test.

If you have a good lawyer, you will win. As far as the giving up the rights of the child, that would need to be on record somewhere. Possibly the bloodsucker (woman) failed to mention that part to the state when she filed for welfare.

Good luck to you! You're going to need it!

If you gave up all legal rights the state can not step in and do that go back and have a paternity test if they don't pay for you will have to. By the way if there is know legal documents supporting you that you gave up all parental rights and the child is yours you will have to pay know matter what.

It depends on the state in which you live. Laws differ in each state.
You can have a meeting with a lawyer to explain the laws in your state, probably only cost you $50. A paternity test is at least $600, are you willing to pay for that?

before you pay child support contact a lawyer and let him know the situtaion, you may not nnedto pay without first getting a pertenity test. do this first before you pay anything.you may stil have to pay but if it is not yours you may not have to pay anything, if there is a court order to show you gave up all rights you may not have to pay either.loo into that and get a lawyer or go to legal aid at your local court house.

nothing this is money lost on you. My father went throught the same thing. She got support from the state someone had to pay and you were probably on the birth certifacte so they went after you. You should have done a dna then.
