It depends on the child(ren)'s age. Most often custody is granted to mothers if the child is young. If the child(ren) are older and puberty age, custody of girls are still granted to the mother but custody of boys are more often granted to fathers if the couple was married. If the parents were never married, custody is usually granted to the mother because it is believed mothers are better equipped to nurture young children especially during the formative years. The burden of child support is usually ordered for the father (absent parent) because traditionally he is believed to be more able to earn a living. Absent parent fathers are still expected to spend quality time with the children as it has been found that a father figure is very important in the successful upbringing of children. Times are changing, though. There are many factors determine who gets custody even if it is shared custody and who pays child support. The courts are obligated to order what they feel is best for the child(ren).

As a child support enforcement caseworker for 10 years, I have witnessed the narrowing gap of which parent receives custody and which parent receives child support orders. The public child support enforcement agencies and the courts are better informed now to make fair decisions regarding family matters.

your rights are determined by the laws of the state where you reside, and by the court document regarding the custody of the child(ren).

There are two forms of custody: legal and residential. in most cases, both parents share legal custody regarding decisions in the child(ren)'s life, but usually one parent (commonly the mother) has residential custody because that simplifies it for the child to have one regular home and school etc. and to visit with the other parent.

Visitations rights are also determined by the court depending on the history, and can be altered as needed.

because assholes like my dad screw it up for good dads like my boyfriend. his ex makes it as difficult as she can for him to see her, we drove 3 hours to have lunch with her and 3 hours back today...then he went straight to work to continue paying child support.
