If it is an eight hour work day it has to be taken prior to working five hours.

A 15 minute break is earned for every 4 hours work. A half hour lunch break (not paid) is required after 6 hours work. In an 8 hour shift a person should have a 1/2 hour lunch and 2 breaks.

I believe 4 hours is the standard. However, if you are working a split shift or you are part-time only, you may not qualify for a lunch even if you work 5-6 hours a day.

check with your state labor board but in general most states set this time as 6 hours at work then a 30 minute lunch brake is mandatory
