If you have not yet purchased the house, you should make a certification that the house is termite (actually wood destroying insect) free as a condition of the sale. Such an inspection should be carried out by a licensed exterminator. In many states such an inspection is required by law. If you find the termites after making the purchase, then you are stuck to prove that either the previous owner concealed knowledge of the problem or that the inspector did not perform the job correctly. If you are at that point, you need a good lawyer who can help you with the laws of the state in which you live. I can imagine that in some cases the buyer could be stuck .

It depends. The buyer could make it a condition of the sale that the termite repair is done by the seller. Or, the buyer could negotiate the price down if they agree to do the repair.

You need to read the terms and conditions of the purchase. Check with the escrow company. Typically the seller pays or buyer and seller negotiate/compromise. If the seller refuses, then back out of the purchase. Somewhere in the escrow it should be written that termites are grounds for voiding the purchase and entitles you to a full refund.

There is a Disclaimer when you buy a house......this is to protect the buyer...if the seller knew there was termits then they are responsible for the repairs if you can't prove this then the buyer is responsable.....hope this helps one other thing....if the house was inspected by a home inspector and they missed this you can also sue them for responsibility

if the seller wants to sell then he will pay,, if the buyer is dumb enough to buy a termite infested house then he pays,, if the seller misled the buyer he may be responsible,, the buyer has the responsiblility to find out before purchase unless the seller deliberately hides information...

I the seller is aware of termites before the sale he must pay. If the buyer finds them and seller knew but didn't disclolse termite probem, seller must pay.

If it came up in the pre-closing inspection, the buyer can ask the seller to pay. If they are discovered after closing, it's all on the buyer.

The seller should be responsible unless the buyer agrees to buy as is.
