We are wondering if the employee must be brought back in the position with the same rate.

It depends on the state. In general they are not guaranteed the same job, though some states require "comparable" work. If there was an industrial injury, there is often light-duty work before the employee is ready for his or her old job.

In most cases, employment is at will, and the employer can re-assign or terminate employees at any time unless there is a contract to the contrary.

Depends what state you're in. In Florida, after a certain amount of time, they don't have to hold your specific job open for you, but they have to have something you can come back to no matter what it is.

It depends on many things...two main things being: amount of time on job, and state law.

It was my understanding they had to have "a" job to come back to.

i thought they did but sometimes they don't it depends on the job
