I was at the gym last night taking a kickboxing class. The instructor gets a kick out of making us work really f*cking hard and she started to piss me off. I got tired of hearing "hook, punch, kick, kick back, squat...ect" over and over and over again. We were about 5 minutes into class and I was hurtin. So, I moved a little bit closer to her each interval until I was within kicking distance from her head. The next time she told us to high kick, I knocked her on her a$s. The rest of the class cheered but she got really pissed and cut up my membership card. Do I have a lawsuit? Shouldn't I be reimbursed for the yearly fee that I paid in advance? After all, it was only my second day at the the gym!

My question is why would you take kickboxing? You should switch gyms. My gym offers one of the most dynamic, popular work outs around...Knife Fighting. It's a partner style workout method where if you don't finish the workout, you die. So there's a lot of drive there to stay on top and get your stuff done.
I would contact the gym and find out if maybe they offer a knife fighting course or something. After you take the course, go back to your first gym, wait for the instructor in the parking lot, and practice your new workout until you have her purse. That should be a good reimbursement. Do this every couple of weeks until you are satisfied with the way you look and your refund.

Why did you take the class in the first place? There was nothing keeping you there except the money you paid. If you didn't like the class or the instructor leave. It was VERY WRONG to do that to the instructor and I hope you don't get reimbursed. If anything the instructor may sue you. Next time think about your actions before doing them.

You should first read your contract. I imagine that somewhere buried in the small print states reasons you membership can be cancelled. Assualting a staff member is probably somewhere under there. You're lucky you weren't arrested. She would have been well within her rights to call the police. You should get rewarded for attacking someone. Maybe at the next gym, just leave the class and hit the treadmill.

I don't think you have a lawsuit. Maybe a cross complaint of assault and battery.
Your admission shows it was willfull and premeditated.
If the whole class didn't like the thing doesn't really matter. Two days into it. Is it a gym or a martial arts class? Rotating teachers? Sounds like it.
Yes. It was absolutely wrong.
She would've seen it coming if it was. If it was a good group somebody should've spoken up and said, can we move onto something else.

Last time I checked, that was asault. You kicked her on purpose. Yeah sure you say, "oops, my bad." But your intentions were malicious. The gym doesn't owe you squat. I would imagine a kickboxing class requires alot of kicking. What did you expect? Next time, show some maturity.

This was totally wrong! And immature! And just plain dumb!
You could have just not worked as hard as she "wanted" you too. Shes not your mom! You have the power to work out as hard or as easy as you want.
You should be hoping they dont file a lawsuit towards you, or being counting your lucky stars they didnt arrest you right then. Thats assault, brother.
I say, work out on your own, because its obvious you can't play well with others.

Why didn't you walk out the class if you didn't like the way she was teaching instead of kicking her. You can't go around just kicking people.

Any chance of a lawsuit you might have had, would no longer stand a chance as you now have about twenty million witnesses for the instructor to say that you assaulted her intentionally....... If she finds out she could sue you...............

You should consider yourself lucky that she didn't press charges against you. Your behavior was totally inappropriate, if you were unhappy with the class quit. You never have the right to strike someone unprovoked. Grow up!
