Congress has the exclusive power to declare war according to Article One of the Constitution. Article 2, Section 2 has served as the basis for the President to send troops into battle without a congressional declaration of war. In the legal sense, however, war can only be declared through the Congress.

To declare war...Congress. However, the president may use the military for 90 days without Congress' consent, at the end of the 90 days Congress must declare war or the troops must be pulled.

Congress is the only body which can declare war. The president CAN send troops to a place, but must update congress within 60 days. In our history, we have sent troops without declaring war over 250 times. Obviously, we can have a "war" without calling it a war or declaring it (often called a "conflict). But in answer to your original question, only Congress can officially declare war. I believe with a 2/3 vote? or perhaps 3/4 vote, i can never remember.

Congress, per the Constitution. But it seems that declaring war is passe. As long as they give the President's authority to use military means, and pay for it, it is the same thing as declaring war without having to actually declare war.
Then they can say they were against the war before they were for it or some other flip-floppy footwork.

the president is the commander in chief and he has all the power. It is usally best to have the backing of congress but the president ultimately makes all the big military decisions like declaring war.

article 11, only congress shall declare war. in the event that congress cant respond the president along with the joint chiefs of staff can declare war. but as weve seen the usa is too docile to hold the reins of their government.
