If you have filed what he is doing is CONTEMPT of court! Neither party can keep a child from the other party.
You need to make up your mind if you want to have joint custody where for example you have her one week him the next or....full custody where you have her and he gets visitation rights. Most states will encourage a joint custody...makes it a little easier. If I were you I would start getting going on the paperwork for filing. You can file a pro se on your own..depending on your situation you maybe able to file a waiver of fees. contact me at summer_kisses_06@yahoo.com and I'll help you thru. I myself am doing this and have 3 children.....Ill be more than happy to help you.

If you don't want to lose her all together, you need to go to the courts and show that you want her. If you wait 5 years and say to the judge you want her, they will think you have a motive or will hold it against you that you waited so long to do legal action. Be there for her and spend as much time as you can in the meantime.
He's right though, you should request to see her by giving him some notice and not just showing up. It's rather inconvenient, especially if he has moved on with his life and has a new family. Keep things civil, it makes it easier on the child.

Is there a court order in place? Why did he keep her and not you in the first place. If there is nothing in place stopping you from seeing her then call the local police station and ask them what to do. They can point you in the right direction, whether its a lawyer or something you can file in the meantime on your own at the court house. If talking to your ex doesn't help. If it was me, I wouldn't let him stand in the way of seeing my child. I would do what it takes.

first off, why ever do you not have a Court ordered visitation agreement?
why does husband have the child?
why would you want full custody?
to obtain full custody of a child, the other parent must be deemed totally unfit to raise the child. very rare.
parents need to think of the child(ern) and stop their bickering battles which detrimentally affects the child(ren).

If you want to see your daughter you should at least file for joint custody, if you feel you are responsible enouph to take proper care of her. Sorry to say but it doesn't sound unreasonable for your husband to want advanced notice when you are going to pick your daughter up. Maybe they have plans, or are trying to set a routine.

If you are seperated you should discuss it with your lawyer. Usually the judge give custody with one parent and visitation with the other. If you don't have a lawyer its probably time to get one. Hope this helps.
