I know someone who is being accused of being a father but the only proof is that the "father" was not the father according to the DNA test. The woman wants him to sign over his rights without a test. I dont even know where to begin with this situation.

Never ackowledge paternity on paper. This will bind you in court.

An suspected paternity can only be proved by a DNA test. No ona can harass or coerce to sign any paperwork to admit paternity without a test.

If the lady in question is sure and is seeking either Child support or adoption paperwork for the child, she should contact the closest Family Court and the prospective father would be called to go after the court. The court then will inform the person to take a paternity test. The prospective father would pay the amount of the DNA test that the court accepts as legal (not the do-it-yourself kits taht are NOT admisible in court, so don't waste your money there). If the result comes positivem, they will go after that, if it comes out negative, the prospective father will be reimbursed.

It's important that you don't sign anything, but be a gentleman and cooperate providing the evidence necesary to accept paternity and responsability or have your peace of mind.

Well, he cannot sign over any rights if he doesn't even have rights so to speak. He would have to petition the court for a DNA test to establish paternity. If he is the bio father and wants to keep the baby, he can then file for visitation and placement rights. If he doesn't want the baby, he can voluntarily sign off his rights so that the child may be adopted by a spouse of the mother of the child.

the tests cost a couple hundred... if the man IS the father, he pays, if not She pays...
he might need a lawyer
