He left when she was 2 months and she is three and a half now. He is not in the picture and she doesn't know him. I've talk to some people in social services that told me if something should happen to me (I die) then they will try and find him (He never told us where he was going and never contacted us) and that is where she will be placed. I am getting married, but the subject of adoption hasn't come up yet. He loves my little girls and she says she wants him to be her daddy. This is something I want to do for her, and I have good reasons.

Some states have a 7 year max of no contact by the other parent, you then can file to have the parental rights terminated. Think of the consequences for your child when they are older, will the other parent be able to come back to that child's life and blame you for the no contact? The only good reason to terminate a parents right is to open the way for adoption by a new spouse.

You will have to get an attorney. It is very hard to get a parent to do that... Even though they may have not been in the picture for some time. In some cases is can be easy. You should just contact any Family Law Firm and ask them what you should do. It consists of TPR work. )Termination of Parental Rights.

You can get a legal document drawn up and have him sign it give away his rights but if you want to do it without contacting him then you have to get an attorney and the attorney will file a document with the court asking the judge to terminate his rights. First they will put an add in the paper with your daughters name and you name telling what you are doing and give him 6 weeks to respond and fight for his rights. If he dosent respond then the judge will sign it terminating his rights.
And no he dosent have to agree. If the judge feels its in the best intrest of the child he will sign it.

I don't think you can do it, unless he signs the papers giving up his rights. Maybe in the mean time you can appoint some one in your family as her guardian, in case something happens to you. Such as a sibling, your parents, or someone like that.

You need to find what kind of legal past he has. If there is something to exploit (i.e. domestic assault) you can use that against him in court. If he can't hold a job, this is another opportunity....

i want an answer to this to mine is 6 he hasn't paid support and he tries to see her only when his life can fit her in which isn't often
