It is 3 am right now and I have these damn birds that have been chirping since 2 am. They wake my son up all the time. He just got up a few minutes ago. Mommy needs some sleep. I have no idea what kind of birds they are.

I don't own a gun. And, I don't think I will be sitting outside in my PJ's trying to shoot them down.

They are in the trees not the window sill

I can see where the birds would be bothersome - I am a bird lover so the cruel way is not for me - this is a more humane way to rid the window of birds - find an OWL - plastic or ceramic, post it close to the window or roof or even the tree - for some reasons birds will stay away from a place where an owl is present - they cannot tell that it is not real - it works

I know a lady that reccomends putting tinsel in the tree. There are also blow-up snakes (These have to be moved every few weeks) I don't know how well those would work at night. You might be better off with the plastic/ceramic owl.

OK, that's the humane way, which is pretty cheap. Now for less pleasant ideas: I don't reccomend buying a real snake. Animal control may have issues, and it would probably die in the winter time. While you're not too keen on the birds, I don't see why you should be inhumane to a snake.

You might take to washing out the tree rather well. Use a good hose and a nozle, both turned to full blast. This might knock down a nest. You could also try it near night fall, which will make the tree a little less comforable, but may cause mold to form.

Some stores sell stuff like big flypaper that is supposed to get birds stuck in the tree. If you can't find that, a similar trick can be done by coating twigs with tar, or honey, and sticking them around the tree. You'll need quite a few to make it work though, unless you bait it. This may attract a real owl, which will eat anything you haven't gotten yourself, and makes for less messy clean ups.

You might try the old gopher, or rat poison in the bird feeder trick. This is technically illegal, so if you've never heard of this trick, and you don't know how to do it, I can't give you instructions.

If you feel like sitting up in the middle of the night, you might keep a hose along with that gun you don't plan on keeping. Getting them wet makes it hard to fly once you start shooting. I'd reccomend a BB air rifle, rather than a standard gun. There's usually no waiting period, and stray shots are less likely to hurt anyone or damage property.

Laying a net over the tree would also be an option, as birds instinctively fly up when scared. Of course, what you do once they are caught is anyone's guess. Just on a hunch, I'd wager that if you don't plan to stay up and shoot them you probably aren't very keen on taking down a net in the middle of the night to club them to death. Of course, the neighbors would be rather entertained, and/or horrified if you tried to do that in a night gown.

Well, there's a few choices.

You could put a motion-activated sprinkler in the tree -- when they land, they'll get drenched. Just be sure the window is closed!

Also you could try putting a plastic own in the tree or on the windowsill near the tree -- many commercial buildings have these on the roof to keep the birds away.

I know this will sound like a nut-job idea, but I swear it will work:

go to the pet store and get a rat snake (not just any type of snake: a rat snake eats birds, too). Get a ladder and put the snake up in the eaves of your your house. The birds will not go anywhere near that place anytime soon.

Try rigging up a scarecrow, perhaps with some sort of light near it.
I wonder what is attracting them. Perhaps finding out what sort of birds they are and ringing the wildlife service in your area may help.It seems weird that they making such noise at that particular hour.

they probably want to make some nest on that tree. why dont you make some nest far from your son's window and try to guide the birds to live in it?
