I have a situation with a woman under the age of eighteen who is set on marriage with her boyfriend in San Diego, California. I know you can get a marriage license if you have a parent consent and counseling for three hours. Now, here is my question. Her boyfriend is over the age of eighteen, and she is not. Technically, it is illegal for them to be together. Would that hinder the marriage for them? Are they even allowed to get engaged? What is the law on engagement with a minor? Please help. This young woman would be very appreciative. Please, do not type things like, "she shouldn't be getting married at that age anyway". I'm also just curious for my own information what the law is. I don't need opinions, thank you.

I don't know if the age of consent there is 17 or 18, but there would be issues with sex if she's under that, regardless of engagment (which is meaningless legally). So far as marriage, yes with parental consent it is legal & no real issue.

you are not giving enough information where does the girl live? does her parents consent to her marriage? and how old is she? all these things have a bearing on whether she can marry this guy or not.different states have differnt consent and marriage laws....if the girl lived in Texas and was 17 she would be legal so it depends on all of the above issues.marriage and consent laws vary greatly on many things. You should definitely check the consent laws in the state of the underaged girl becuae where the boyfriend is isnt necesarrily the only issue if the girl leaves a state where it is illegal she could get the boyfriend in serious trouble.

he can definitely be married at 18, but she would have to get parental consent to walk down the aisle or ese it is illegal. but dont take my word for it, look up marriage law for that city/state and be sure. but I really think what i mentioned sums up the underage marriage thing.

P.s - if he is 18 - how old is she, hope she is at least 16 going on 17 ...

sumone i know is in the same boat.

it wont hinder the marriage if the parent signs a consent form saying they can get married. other then that it what any marriage would be like.

i would still let her consider about marriage to him. i mean adults or teenagers reconsider sumtimes when they get into marriage and they couldn't handle it.

Him having any kind of relationship with her is illegal PERIOD. She should just wait until she is over 18. I don't think she would want to risk her bf going to jail for statutory rape.

It would be illegal for them to have sex and not be married, once legally married, then it is not a crime.

( that is why they allow for parents to sign for children to get married)
