I believe if your parents have joint custodial rights you can choose what parent you want to live with. To be certain call your dad's attorney and he can tell you for certain. If your dad only has visitation you can't move in with him without a court order. It also sounds like if that was the case you have a compelling argument that you don't like your moms boyfriend. You can move in but it has to be decided in court. Are you willing to go in front of a judge and tell them you want to live with your dad and not your mom anymore?

Usually when you reach the age of 13 you can pick who you want to live with. Even if you went to court the judge would ask you who you want to live with, and your answer would stick. Make sure your dad says it's o.k. Have a happy life!

Your dad has to really want you to move in, and he has to press the issue. If your mom's boyfriend is a real jerk, and it's affecting you, that will make your mom look bad, and that will help your dad win custody of you.

I'm not sure,but if mom presses the issuse you could make her look like an A$$ in court because the judge will listen to your opinion.

Just tell your dad that you dont living with your mother's bf and if you could move in with him. And if she does put him in court, the jury will rule in your favor cause you dont like living with you mothers bf.
