Send my sympathies on your friend. He can sue, but the condom manufacturer will try and make it look like he put a pin hole in the condom before being hit by the bus. If there is a hole in the condom they are no longer totally safe.

He may have a case against the bus driver and the company he drives for but probably not against the brand of condom he was wearing. Most condoms have warnings on the box that they are not 100% safe. Definitely sue the driver and/or the bus company. My sympathies to your friend for his...unfortunate accident. Hope it all works out for him. :)

If he was wearing a traditional condom he would've been safe had the bus only hit him right there at comedy central. Now, had he been wearing a full body condom, all would've been swell, so to speak.

Now if he was in the privacy of his own home and the bus crashed through his bedroom wall, he should definitely sue, however If he was on the bus's route, the less said about it the better.

No, when wearing one you totally void your right to sue. When you slip it on all legal merit is gone, they have what's called a disclaimer on the box. If it busts your busted if she procreates. I don't wanna be crass but invest in a DNA test to be sure if the girl is suspect. Did you save the condom from the scene of the accident ? If not dude welcome to daddyhood. If you did save it does lab research prove it's defective, not you ? Sorry, your a daddy unless that baby isn't yours.

They are not "Totally Safe". Read the labeling! there is no guarantee that a bus will not hit you while wearing one.

Ah! Rubber tyres, you see...magnetic. I think if you check the contract details written on the inside of the condom, then you will see there is a clause that says something like: "To avoid pregnancy, be like the buses, and try to pull out on time." Sorry dear, I think your friend doesn't have a (middle) leg to stand on.

If somebody on the bus gets pregnant I would sue, or if he caught VD from it.

Yeah, definitely. He did everything he could to protect himself. Totally the bus driver's fault!
