If a court order for child support was ruled in a Louisiana court (Lafayette Parish) and it doesn't have a specific date that payment is due (only shows $325.00 per month), according to Louisiana law how long does one have to wait for it to be considered in arrears to file contempt?

This has happened before, but I waited 3 months before I filed successfully without a lawyer.

But now his child support is tied in with his probation (if he doesn't pay, it will be considered a violation of his probation and he goes to jail without anymore chances), and I'm not going to give him one bloody micrometer of slack!!!

He is working gainfully.

He's just been a total *ss from the begining. He also molested my daughter and tried running from it (that's what he's on probation for), he is a sex offender.

sounds like you should call his probation officer I'm not familiar w/La laws but in Texas it's up to the probation officer as to how long he can slide by but it's usually no more than a couple weeks such as 'man, they messed up my pay check and I ain't got the money' whatever excuse to get them of his back until next payday

Well, I would suggest getting a lawyer to make sure that you get all this straightened out in your favor. By not having a " due date" you are setting yourself up for all kinds of interpretations! Also, see if you can get his wages garnished and then the state gets the money from him and disrtibutes it to you. You can get it directly deposited in your account, or get a check mailed. Then the state will also hae their records of payments and those records will protect you.

well in michigan it needs to be at least one month or $350.00 but it need to be a whole month which means the month ur in now dont count....after that u call ur worker and put in for a "show cause hearing" which will generally take 2 weeks for u and him to get ...u can also show up although it says u dont have too...do it .. then he either pays his arrears or go to jail...if he dont show up a warrent for his arrest will be issued....

I think it may be up to the judge, after your complaint is filed.

it depend on what happen if the guy lost Job or sick or it up to the courts
