My friend has a DVD he bought which contains information by a famous author. Not many copies of the DVD were sold and each person had to sign an NDA.

I actually signed an NDA, but there were not enough copies and I didn't get one.

My friend wants to sell me his. As I have signed the NDA - is this legal?

Pamela: Thanks for answering quickly. Would he be in breach though if I've also signed the same NDA? i.e. the confidential information is still protected.

You should also contact the people who originally issued the NDA and demand a copy for yourself. You should have ALL papers you sign on hand so you can refer to them if ever necessary.

If your friend signed an NDA, then he would be in breach of the NDA. You shouldn't have a problem if you signed an NDA because you are not the one selling the DVD.
