This is a very difficult question to answer, since there are probably not records that old. We do know that there were criminals and courts in ancients times (Egypt, Greece, and Rome, among others). For example, we know that Socrates was convicted and sentenced to death (or exile, he chose suicide) (for corrupting youth) by Hemlock in 399 BC. Now, this wasn't the first or the first recorded, but it will give you an idea of how far back this goes!
