We're not married, but we have a 4 month old baby together. We split up because he was very abusive.

I think someone may have touched on this but, you need to go to your local state's attorneys office (also could be district attorney/People's attorney .. it varies by state but it's still the same thing). Abuse is the same in almost every state statute, and all states allow for abused persons to file complaints. That is the first step. That will ensure that you're abusive X will have more than enough legal problems to deal with other than trying to fight custody and use your child against you. (BTW, a child custody battle is extremely difficult for us men to win during a divorce situation, and is damn near unheard of when the parents were not married)

From there, the same prosecutor that you deal with in the state's attorney's office will more than likely assist you with seeking child support. Also, most attorneys offer a free consultation, and there are numerous legal aid societies (free or cost-reduced lawyers) in every state. in the internet just type in "legal aid MYTOWN" where mytown is the town you live in. You'll get plenty of hits and can go about selecting someone you'd like to use.

Hope that helps!

GO to your local courthouse and make a court date for child support. They will send you something in the mail or just ask them, what you should all bring. Never bring the child to court. The judge will take it from there. If your ex is out for revenge or you feel he will fight you for custody, make sure you get a lawyer or talk to a public defender. GOOD LUCK.

You should contact your local Child Support agency to begin the process. It will involve going to court and your ex may have to undergo DNA testing to prove he is the father. You can expect possible multiple trips to court until it is final.
