File suit against them, you must have appropriate documentation. Ie, cancelled checks in order to do so. If you simply gave them cash, you can not file on that. If you paid certain bills for them, keep those receipts, etc. Once you obtain judgment, you can garnish wages, bank accounts, savings accounts, and put a lien against their home.

All of the above are right! Try to get collateral from the individual in the mean time & if the person refuses. Take it to court.
