I don't know specifically what you are referring to but where I come from to 'bum a ***' means to ask someone for a cigarette, so yes, it's true you can do this without getting arrested.

I think this is a bad American joke.... If you mean can you ask a passerby to give you a cigarette without being arrested, that depends on the local vagrancy/begging laws.... if you are asking if 2 homosexual males can have sex in public without being arrested, well if they are caught then they will arrested and probably charged with public indecency....
