It is legal for a number of reasons. The main reason is more than likely the fact that the company probably has policies against drug use and those policies include the use of marijuana. It does not matter if it is prescribed or not, it is against the companies policy, which means he was fired for not following policy not drug use. Being that this policy is/was in effect from the time of his employment he should have checked the wording of the companies policies.

Did your friend discuss this prescription with the employer? What was he/she prescribed marijuana use for?there is a lot to be considered here.if there was an accident at work and your friend was involved in anyway and had a hot test, then more than likely the employer was in their legal right.I am not 100% sure of that though best to contact a lawyer.

Legally, a job can fire you for any reason under the sun, even if they don't like the color of your hair! Sorry, i wish it wasn't true. If you really wanted to make an issue over it you could say its discrimination and find an attorney that will take your case but its very hard to prove discrimination also. Sorry this is happening, everyone should be smoking pot in my opinion, hey would you please share some with Bush, he needs to expand his mind on life and not money!

i think this is immoral, if he has a prescription then its okay...unless he did it on the job or just before work, then i think its fair that he gets fired, cuz that makes the company look bad if hes all high at work. but if u have a prescription and u only do it at home then it shouldn't be a problem.

Marijuana is a control substance schedule I drug, which means it has no therapeutic use, how did he get an RX for it? What country do you live in? Do you live in California? If it is a legal rx, then it is just immoral.

Did he tell them BEFORE he took the test that it is legal and then proved it? If so, he has a case, if not, he shot himself in the foot.
