The gate was padlocked to the driveway and they still entered the premises via front gate/pathway and walked over my grass and took the matter into their own hands even though they were told that they were trespassing. No court order or bailiff and they said that they would take posession via a crane over the padlocked gate?!

You are behind on your payments. You did not live up to your word when you said you would pay. You are now trying to prevent the finance company from taking your car, by locking it inside a gate.

Either pay what you owe, or they are going to get the car. The more problem it is to get back, the more the repo company will charge, and ultimately the more you will have to pay!!

Quit crying about them coming to get the vehicle and take responsibility for your own actions and failure to live up to your obligations!

Well , i think using a crane is just boasting by them. But as sneaky and scumbaggish as repo guys are (i hate em with a passion) i'm not sure what you can do AFTER the fact that they got your car. They initially have to notify the local police and the dispatcher (police) usually has a list in front of them and chances are they already knew the repo dude was coming. All i know is that there is some law that dictates that a repo person should not pursue a car if the act is beyond a peacefull reposession. But you can check to see if you can get them for tresspassing or whatever , and anything else you can think of that wasn't "peacefully" done. My neighbor does repo on the side at night for $100 a car and i told him he ought to be ashamed of himself, and he explained to me that if he goes to an address to get a certain vehicle and he sees a baby's car seat in it , he just walks away, and he claims he goes up to the people himself and tells them he's there for their car , he doesn't do that sneaky "grab and go" thing that all those other idiots do. good luck to you though..

If the vehicle is locked up on private prooperty, they do not have a right to enter the premises, especially after they were warned that they were trespassing. If they have a police officer with them or a court order, it is a different story. Usually, they will surveillance the premises, when you drive the car and park it on public property, they will snatch it up. It is definitely against the law to enter your locked premises to retrieve the vehicle, late on payments or not. I would contact a lawyer and sue, especially if you have witnesses to the incident and it happened the way you are describing that it happened.

ok tell them to get a crain and get it you would like to see them hook up the car from the other side of the fence since they are not allowed on your property and another thing if the property the vehicle is on isnt yours there is nothing they can do and whoever owns the property the car is on can place a storage bill against it and it must be paid before the car is returned just go to the court house and turn in a mechanics lean on the car for storage higher then the amount you owe they will give the car to land owner for bill ... that is a shady way of doing things but it works.

Only a certified bailiff car enforce a court order for repossesion. You should demand to see both the court order and their ID. if they can't provide you with these, stand your ground and call the police. Good Luck

It is there property. You can't keep them from it by locking the gate. Your anger is displaced and should be directed at yourself for not honoring your end of the purchase agreement. They don't want your car. They want their money.

Think your pissed now, wait till they sell if for less than you owe for it and sue you for the balance!

They walked over your pathway legally, to enforce reposession. They were not trespassing, they had the right to be there.

I would let them take it. They will just sue you for the amount it cost to rent a crane. If they do that.

they posess paperwork allowing them to take the car back - its not your car if its not paid for - generally they let the local cops know what they are doing too

they should have papers to show they were reposessing your car .but yes they can do it if you dont pay for it they can come and take the car to the impound yard.
