The law take precedence over my brother. And sure enough, I would condemned my brother especially if I know he's the one who have done the crime. Innocent until proven guilty is another question. I'm not a judge nor I'm I a lawyer. However, those individuals have to take an oath. And the public have to be protected. I would have several opportunities to see my brother and if we live in a society were there is capital punishment , again there are ways to prevent him from this kind of punishment. However, my character will not be speared. And I would have to maintain such title. Always remember, each one of us is responsible for our own actions.

Not really sure about your question, but a judge cannot sit for a family member's trial. He has to recuse himself because he cannot be fair and objective.
