Name Of Landlord, (date in top right corner)
for reasons previously discussed, i would like a refund of my rent immediately. if i do not hear from you (by such and such a date), i will assume you prefer to take this matter to small claims court, and will be filing shortly. please let me know if there might be an avenue you might not have discussed with me that could possibly settle our differences as this is a last resort.
(Your Name)
little colder body of letter:
(replace first body of letter with this one if desired)
I'd like to take this final opportunity to ask you for rent to be paid back to me for reasons already discussed. in 24 hours if i do not hear from you or receive a check, i will be filing in small claims court as i believe you wrongfully (place reason here, could be reason such as "let living conditions become unacceptable", "harassed me previously", "maliciously took and kept things from my place of living" any of these are good reasons.) for this (or these) reasons, i wish to end our landlord tenant relationship and collect what i believe is mine. please respond as soon as possible.
a lawyer is a much better person to talk to about this, as i am not responsible for any and all outcomes these letters might bring, good or bad.

It's rather difficult to advise you how to write a letter unless you specify WHY you feel entitled to money back. Even without knowing all the facts, the letter doesn't have to be very fancy. Just explain why you think you are entitled to the money back. Set a deadline and mention that you will file a small claims action if the landlord doesn't meet the deadline. If the landlord doesn't comply, then file your lawsuit.

What are the circumstances? Is it about a rental deposit after you moved out? The landlord has 30 days to return the deposit.
It's different in each state; check with a tenants rights organization.

rent usually is not refunded. a contract should always be drawn up before moving in month to month are yearly. if he breaks the contract and you have not damage his apt and is willing to move he will check the apt for damage and no damage he will a good land lord will give back the un used rent and deposit back unless the contract was violated. dont really know what is going on cant be sure if you are intitle to good luck

Dear Landlord, If you don't return, my rent money, for the following reasons. I am going to bury you in paperwork, for example. If your income & rental properties are not safely in the name of a Trust, or a LLC, I'm plan on tying them up for awhile; To be safe from me each property will have to be it's own LLC, and you can only one per bank so you have to have that many seperate accounts and different banks. Please return my rent moneys in the following amount, or I will bury you in paper work and ravage your life. Thanks, Tenant( Joe Dotes) , Certified Letter.
