I filed for divorce seven months ago in Oregon. My husband responded, but we haven't been to court yet. What is the process? We do have a child, so there are custody issues. And I have a restraining against him.

Did you file Pro Se or did you use an Atty?.... If you used an Atty, why ask us, you are paying hin/her 150-250/hr.

If you are going Pro Se be careful what you tell the judge. My ex said many things.... I stood there with my mouth shut... after her rant, the judge asked if anyone in her family was a politician.... because she seemed to have mastered the art of the filibuster! Then said to me "just because she said it, it doesnt mean I believe all of it".... "yes your honor" was my response.

Most judges understand that a pre-divorce restraining order is usually recomended by the womans atty and isnt always founded in anything (whether or not yours is, is irrelevent) and is sometimes little more than a tactical move. My ex attempted to get one and couldnt get a cop to buy her story... which isnt all that hard for a woman to do... the cops are afraid NOT to arrest a man if they think that it's even POSSIBLE that shes telling the truth. No order was ever given. The point is.... an order isn't always a guarantee of getting what you want.

Talk to your lawyer and find out. See what your options are and go from there. I am not sure what the process is here!
