My bank is a pain, it refused to pay a cheque even though there was money in my account to cover the balance of the cheque. They charged me £35 even though I have a letter saying it was their mistake, but the charge is going to stand because of the costs they incurred by refusing payment. I have since researched the UK law and the office of fair trading reported on the 5th April 2006 that the bank charge are wrong because they can not charge more money then what it cost them to deal with the issue therefore they are presumed to be unlawful in the absence of specific proof to the contrary. How do I get my bank to give me back my money seeing that they have stolen it.

Already spoken with the bank manager and he said even though it was their fault the charge is going to stick because it is what it cost them to deal with the issue.

A website has been set up and provides stories, amount and guidelines on how you can claim back these excessive and unfair bank charges for the last 6 years. I have listed the address underneath but I am not sure whether you need to register or not (its free). Very helpful for anyone who has been stung by the banks.

I would take the letter to the banking Ombudsman, any Consumer Advice office could give you the address. I would then give the Ombudsman the full details of the problem and let them deal with it.
I would then change banks and tell everyone I knew about what happened, naming the bank and branch and generate as much negative publicity as I could to let the manager know that his customers are assets and he is a liability.

Yes. I had a 2nd account with low funds for Internet dealing. I gave instructions that it should have no overdraft so a large amount could not be withdrawn by fraud. They did allow an overdraft and charged me for it! I reminded them that other banks are in the high street if they did not refund the charge. They did refund it.

Regarding a credit card charge, I rang them up and asked it reversed as a gesture of goodwill. It was done.
I suggest you doing the same if you can. People who work for credit cards have the power to reverse certain charges (I worked in a bank and I could refund up to £25 without consulting with anyone). Be polite and understanding and you never know.

Yes, I got fed up with the local branch, so i photo copied all the paperwork proving that they were in the wrong and sent it to head office, I got over £75 back due to the incorrect charge I know it's not a lot but I beat the banker.

Best to ring them and ask nicely if your charge could be refunded and they may as a gesture of goodwill. They will only do it once tho so if it occured again you may not get it. I have read a news item that customers who sued Alliance and Leicester for wrongful charges won the case but then were told to terminate their accounts.

yes i have had a charge with halifax and i rang them and told them it was another companies fault for taking the money and i didnt think they were going to. the charge was 30.00 and that is per charge. i think with some banks it has to be 10.00(uk) to have a charge but check on their website or call them asap.the issue can normally be resolved esp if you have never been charged before. HSBC are really good with refund and barclays. just get really angry! good luck!

i wrote to alliance and leicester and simply asked them to refund the £38 charge i had incurred through lack of funds to cover a payment. i said i wished to continue using their bank but would only do so if they refunded me - and they did!

begin the campaign of terror... begins like this , get on the phne and be super friendly, before you get to talking about your problem and its possible resolution get the person whith whom you are speakings name, personal extension, and the extension of THIER boss, then tell them the problem, if they cant solve it in 5 minutes, call thier boss, work your way up the ladder and if they cant solve it in one day, call back tomarrow and start your way up the chain again... after a few days they will be so sick of you they will gladly refund your money
