My daughter is having a baby with her long time boyfriend. Whos last name does the baby have? Please help, the baby is due soon. And of course there is a big argument going on between them. She thinks the baby should have hers and he thinks it should have his.

The baby could legally have either. Its a decision that your daughter and her boyfriend need to sort out. If they intend on getting married eventually then they may want to use boyfriends name right away to avoid paperwork and hassle later. If he is to remain just a boyfriend then definantly use her name.

The decision us up to the mother. Becasue they are not married the baby will auto matically be using the moms last name...(in the nursery the babys crib will have a tag saying moms last name). A hospital employess will come to your daughters hospital room with birth certificate papers and a paternity acknowledgement. If you want the Dad on the birth certificate he will have to sign both items. But if your daughter fel treally strongly about it she could do the papers herself.
Basically there is no law or standard for that situation..they have to agree on something OR she can go ahead and take care of the paper work without him...OR
dpending on how smart this guy is maybe once he sees the tag says moms last name he will think the decision has been made and think there is nothign he can do!!!

Well, it will be easier on mom and baby if they have the same last name. Not saying that plenty of parents don't have different last names for whatever reason and do fine, but when dealing with things like traveling with baby (especially out of state or country), doctor's appointments, school records, etc.... it's just simpler to have the same last name so you don't have to PROVE the child is yours. So I'd say, if he wants the baby to have his last name then they should get married. Not saying he isn't a good guy, but statistics are not really in his favor. And if he ends up out of their lives, it will just be easier on both mom and baby if they have the same last name.

If that is not an acceptable solution, then I'd suggest a hypenation of mom's last name then dad's last name. "Baby MomName-DadName". That way, at least mom and baby's name would be alphabatized next to each other.

Legally, the baby should have the mothers last name, but if your daughter so chooses, the baby could have her boyfriends last name if he adopts the baby. If he does adopt the baby, though, your daughters last name can still be put on the birth certificate. You might even consider putting both of the last names on the birth certificate.

It's a personal choice. If she doesn't plan on marrying him then she should give the baby her last name, but if marriage is in their future I would give the baby the father's last name. My husband's and my first son was born before we married and I chose for him to have my husband's name. If she's really torn maybe they should consider giving the baby both last names or use her last name as the middle name.

Actually the baby can have whatever name they give her on the birth certificate forms they fill out at the hospital before the baby is released. I have a latino husband and there is not one thing wrong with them giving the baby a hyphanated name. Like Joe Doe-Smith.

It is up to you I know some of my friends have named them after the Fathers last name and some with mothers Last name. It is something you need to decide. I know that my friends that were going to be married gave the fathers last name because it was going to be the mothers also in a year. Hope I was of some help.

Legally the baby could be given either last name. They should sit down and try to compromise about it, but ultimately it will be her decision since they are not married she will be the sole person naming the baby in the hospital.

I am not married and pregnant. I am going to give my daughter her father's last name, just because I feel like it's more traditional. However a good friend of mine in the same situation is going to hyphenate her sons with her last name first and than his..
I think it should be between your daughter and her boyfriend.

That is up to your daughter to decide. He has no saying in it - not legally I mean. The baby can have either mothers last name or fathers last name. Or both.
